I think most likely they did aditional takes with the specific purpose of incorporating them into this commercial, if that is the case then they don't need the director's permission to use them as Gaga's team would own that content. 

IMO it really seems to be from the original video shoot.

I don't think those are scenes from any other video or set because you can see her singing "The Edge" and going through the phone to check her feed (in line with what's happening).

But I do think that there were more shots with that outfit which got cut out to fit in all the fan footage and to include all the other scenes. Hence it feels out of place and we don't see much of it.

Maybe the ad was supposed to be longer originally or there were supposed to be more versions. There could even have been plans for one with Born This Way instead (hence the shots with the BTW choreo).
