UK Supreme Court Rules Trans Women Are Not And Can't Be Women

LONDON—Britain’s Supreme Court issued a landmark ruling that transgender women can’t legally be considered women under the country’s equality laws.

The decision in the country’s highest court Wednesday comes after a yearslong legal fight over the definition of a woman in a 2010 law, and could have far-reaching ramifications for the protections and freedoms given to transgender women in the U.K.

“The unanimous decision of this court is that the terms ‘woman’ and ‘sex’ in the Equality Act 2010 refer to biological women and biological sex,” said the court’s deputy president, Lord Hodge.

The move marks a defeat for the Scottish government in its long-running battle with a women’s campaign group over the definition and legal protections for women and female-only spaces.

The Scottish government had argued that transgender people with a gender recognition certificate, or GRC, are entitled to certain protections and to access women-only areas. Its defeat could lead to greater restrictions on the rights of transgender women to use spaces and services reserved for women.

For Women Scotland, the campaign group that brought the case, argued that such access should only apply to people who are born female.

The dispute stems from a 2018 bill passed in the Scottish Parliament aimed at ensuring gender balance on public-sector boards. For Women Scotland said the bill had wrongly included transgender people as part of quotas.

For Women Scotland co-founder, Susan Smith, welcomed the court’s decision but said the fight was likely to continue.

Some of y'all unfortunately don't pay much attention to **** past the headline, I'll likely get flack for this but it's insanely important to have some legal clarity on the situation because it was causing a **** ton of issues.  Before anyone tries saying any ****ing thing, I've never understood why being a trans women is lesser than a woman? Why can't it be of equal status just not the same?

You've just described the "All squares are rectangles, not all rectangles are squares" idea. All trans women are women, not all women are trans. Trans is an adjective - that's why it's incorrect to put them together and the word "transwoman" is invalid.

Being a trans woman is the same as being a woman. Now, if you meant it should be equal status, but not the same as cis, then that would be more accurate and less inflammatory. If you say it like that, maybe then people won't trying saying any ****ing thing to you.

Actually I'm surprised no one said anything so I shouldn't have come in guna blazing like that, it's feels inappropriate now. I'm used to the argument being a minefield no matter what even when trying to be supportive. Yes I think being trans should be equal to being cis but I still think they're should be a distinction especially legally and I don't see what the issue is there.

well, there go my plans of fleeing back home.  can't go home to the uk, can't stay here in the us, will get interrogated like a criminal if i leave the us.  what the hell am i supposed to do?  i'm a trans man, which i swear these bigots seem to think are non-existent, but i cannot support this bullsh*t anymore.  i am so sorry to all my british trans sisters, this is out of hand.  this entire planet has taken ten steps back in terms of queer rights.  i'm so upset.
