Miley Cyrus’ bid to dismiss the "Flowers" copyright infringement lawsuit got pushback

At a court hearing in downtown Los Angeles on Monday, U.S. District Judge Dean D. Pregerson repeatedly indicated he believes plaintiff Tempo Music Investments has adequate standing to move forward with its lawsuit against Cyrus and her co-defendants after Tempo purchased a fractional share of the Bruno Mars song “When I Was Your Man” from one of that song’s four co-authors, Philip Lawrence. In its lawsuit filed last September, Tempo alleged that “Flowers” copied numerous melodic, harmonic, and lyrical elements from Mars’ successful 2013 single. In her motion to dismiss filed last November, Cyrus and her co-authors rejected the claims of infringement, but they asked for dismissal on the grounds that Tempo simply lacked standing to sue.

You can’t just take someone else’s song, rewrite it but still use direct lyrics and melodies and not credit them

They sound like a troll company. Maybe they acquired his writing credits knowing Miley's song was similar just for the purpose of suing and making money out of it. It's a similar method to the one used by patent trolls.

You guys ain’t reading this right, which is common on this site lol.

If a song has multiple writers, every writer must be compensated when said song is sampled. If one of the writers of When I Was Your Man wasn’t credited/paid while the others were then yeah….its called illegal lol. In this case it doesn’t look like anyone was credited, which is even worse - it’s a very clear and famous sample/interpolation

You think all four writers of the song that Abracadabra samples had equal parts sampled in the final product? No. But all of the song’s writers must be credited. It’s also why people hating on Beyoncé for having so many writers is often bogus because most of them come from sampling credits
