Shakira claims she lived on a plane and therefore was not a tax resident in Spain

Shakira has claimed she isn’t liable for €14.5m tax fraud charges because she “lived on a plane” as she toured the world,  even though she has not toured at all between 2012 and 2017, in court documents detailing her defence.

Shakira is accused of failing to pay taxes between 2012 and 2014.

In May 2012, prosecutors say that she bought a house in Barcelona which became a family home for herself and her partner Gerard Pique and their eldest son, who was born in Spain in 2013.

However, Shakira insisted she lived as a “nomad”, spending most of her time touring the world in planes and insisted she was not living in Spain.

“I was a nomad, a person without roots or stability. I travelled at such an intensive pace that I was in three countries in one day. It is one of the prices that I have paid for my career,” Shakira said in papers which were published by El Pais newspaper on Friday.

"I remember flying from Marrakech to Croatia. We were flying over Barcelona and I asked the pilot of the plane if he could land briefly just to give Gerard a kiss. It's the most romantic thing I've ever done in my life. I don't know if the [Tax] Agency will have add up it for me like one day in Spain."

In the calendar provided to the investigation, the Treasury maintains that there are indications to think that Shakira was in Spain all this time, more than 183 days a year . She replies no. “My only link was Gerard. I had nothing but a boyfriend.”
 “Honestly, your honor, I don't know of anyone who is in criminal proceedings for having a boyfriend . That's why I feel like it's so unfair."

Since the Prosecutor's Office sued the singer, her defense claimed that she was a tax resident in the Bahams. However, the Treasury Department has debunked this alibi.  
In the statement, Shakira admits that she, "unfortunately", did not live in the Bahamas during the period under suspicion. She couldn't for two reasons. The first was her music career. Second was her relationship with Piqué, a Barcelona resident.

The trial is expected to take place in November.

Shakira’s spokesman said the singer is “fully confident of her innocence” and that she considers the case “a total violation of her rights”.
