Because Gaga never tried to trademark her lyrics, something Taylor did with this very album that she’s being sued for. That’s why people are saying this will teach her a lesson before she tries to act entitled.

To clarify, Taylor doesn’t own any of the phrases like “This sick beat” or anything. Let’s take This Sick Beat for example, it’s trademark was only filed for notebooks, guitar picks, and shirts. And only for uses directly related to Shake It Off. The entire copyright situation has been incredibly misrepresented, it’s something that many artists do. Even Gaga once went to court for trying to get “Gaga Jeans” by a small company taken down (though she lost the case lol), and Katy Perry has copyrighted the phrase “Meow!” for a few different items. I mean Britney copyrighted the name Britney, so now if your name is Britney and you want to release a self titled album you might have to go through her! The only reason why Taylor’s attempts at copyrighting were because, yes, some of them were common phrases, but it’s not like every instance every of use of the phrase This Sick Beat needs to go through Taylor, just ones relating to her album SPECIFICALLY on the products that were covered under the copyright. I don’t see what’s entitled about making sure people don’t profit off your music and lyrics? 

 

Edit: Case in point, Michael Jackson has the words Thriller, Bad, Gone To Soon, etc trademarked. Ariana has Sweetener trademarked, a pretty common word lol. But Splenda isn’t going to go out of business or have to pay Ariana. It’s pretty standard practice in the industry, it’s just cool to hate on Taylor 🤷‍♀️

I get y’all’s „okay now she’s going to get a reality check“ but hasn’t Gaga taught you anything? 
as someone explained before: it’s a common practice and even if it was a little extra, why send hate her way? 
it just shows that all of y’all don’t really care about compassion and kindness towards others (yes even those you don’t like)

If the blurred lines case taught me anything it’s that since it’s going to a jury they most likely won’t have music knowledge and therefore vote against Swift even though she’s not in the wrong. Those are common phrases used in plenty songs before the cheetah girls
