Lion Heart 15,041 Posted December 28, 2015 Share Posted December 28, 2015 A Cleveland grand jury declined to bring charges in the death of Tamir Rice, a black youth shot by a police officer 13 months ago, Cuyahoga CountyProsecutor Timothy McGinty said Monday. Tamir, 12, likely meant to hand over a "replica" gun he was carrying, but there was no way the officers could have known that when they confronted him on a snowy day in November 2014, McGinty said. He said he agreed with the decision. "The outcome will not cheer anyone, nor should it," McGinty said. He blamed the shooting on a "perfect storm of human error" and miscommunication. "The evidence did not indicate criminal conduct by police," McGinty said. The grand jury was asked to determine whether Officer Timothy Loehmann, a rookie cop, or his training officer, Frank Garmback, should face charges in the killing. The two were responding to a report about a man with a gun near a recreation center on Nov. 22, 2014, on a wet, snowy day. A dispatcher did not tell them the caller thought the gun was fake. Tamir was carrying an Airsoft gun, which shoots plastic pellets. McGinty said the dispatcher's failure to provide the information about the "fake gun" was key to the case. "The actions of officers Garmback and Loehmann were not criminal," McGinty said. I've seen white people waving and shooting with guns and they're still arrested alive or wounded, but this boy had to be killed for a toy gun. Human error, right. Wasn't the state where this happened an open carry state? Starting in 2016 in my state open carry will be legal. We have a disgusting justice system. When a white police officer kills a black child it's okay but when it's the other way around people are quick to speak their empty minds. I'm enraged now sorry but this is disgusting.
