The children in question are twins. They have one biological mom...not moms. Chances are she was a surrogate.

Also, the children are like one years old. The court isn't going to ask them.

They are trying to cross adopt them, so that the non-biological father will be the legal parent along with the biological father. That way, the children will have all legal rights and advantages from both their parents. 

I'm not sure how the judge could deny the biological dad to put his name on the birth certificate.
