The commonwealth has exclusive power to marriage laws and regulations but a state doesnt. Since ACT passed it the marriage wasnt even recognised and in the constitution section 109 clearly states when a law of a state and a law of the commonwealth is inconsistent with each other, the latter shal prevail and the former to the extent of the inconsistency shall be invalid, basically the commonwealth always wins. When I told a friend of mine that Aus was one of my favorite country in the world he said exactly the same thing This is so hard for me to believe, Although I´m not gay i don´t thing I would be confortable in such a place..
