Kim Zolciak’s 15-year-old son, Kroy “KJ” Biermann Jr., filed a legal petition to be released on bond while awaiting court proceedings following his arrest for sexual assault. KJ’s attorneys requested the teenager’s release on Wednesday, September 2, according to court documents obtained by Us. Per the docs, KJ’s legal team claimed that their client is not a flight risk and cited his academic and athlete record as evidence of his good character. (TMZ was first to report the news.)

KJ was arrested in Alpharetta, Georgia, on August 17 for aggravated sodomy and aggravated sexual assault. A judge did not immediately set bail, remanding KJ to the Metro Regional Youth Detention Center until a court hearing held Tuesday, September 8.

The lawyers further stated in their Wednesday motion that KJ faces two felony charges that each carry mandatory minimum sentences of 25 years. If found guilty on both counts, KJ could possibly be sentenced to 50 years of incarceration.

He's been indicted on 7 charges

aggravated sexual battery against a child under 16 x3

aggravated child molestation

aggravated sodomy

aggravated sexual battery

false imprisonment

also, dont know much about US system, but since he’s 15: are these charging expiring when he turns 18?

He's being kept in a juvenile detention place i believe and will remain there until trial

iirc they spent 4 months collecting evidence before they arrested him

In the context of child molestation, from a purely technical standpoint, the charge itself doesn’t necessarily refer to the age of the perpetrator, but rather to the age of the victim. So being a child, or being a minor themselves, does not preclude someone from being charged with child molestation.

Now, I can understand why, in an instance involving two minors, “child molestation” might seem somewhat redundant, or why you might think that sexual assault would have been sufficient.

But I think that introduces a secondary question, which is: how old was the victim?

Because depending upon the statute being applied here, if there is a substantial age or developmental gap between the perpetrator and the victim, let’s say, for example, that the perpetrator is 16 and the victim is pre-adolescent or otherwise substantially younger—then I think there could be reasonable justification (depending upon the specific wording of the statute) that would justify characterizing the act as child molestation as an age and developmental based predation, as opposed to the standalone charge of sexual assault between peers.

And that may be why the prosecution is pursuing that specific charge.

It is uncertain atp. It is up to the judge if they will grant bond. We will likely hear it on the 8th.

Though, as someone who currently live in the same state, and county as them, I can say that the police and judicial system here does not play, they treat child sex offenders with extreme severity. This is also why he is charged as an adult. 
Under the state of Georgia law, a minor can face child molestation charges if the alleged victim is also a minor under the age of 16. The legal definition of "child molestation" applies because the alleged victim is a minor under 16 years old. Legally, the charge is defined by the victim's age, regardless of whether the accused individual is also a teenager

Under the state of Georgia's justice system, certain severe felony offenses automatically allow or require juveniles to be charged and tried as adults, depending on the nature of the crime. State of Georgia law is also why forced oral sex also counted as aggravated sodomy in this case. (Though actually there are more states that have this particular law applied as well)

Given that these are all aggravated charges alongside violent charges (kidnapping & battery). 

I'm willing to take an educated guess that even if the victim isn't significantly younger than him, the crime isn't just a case of 2 underaged teens getting caught and 1 set of parents going to the police. 
The charges paint a very very dark picture of what happened.

No doubt in my mind that what happened here appears to have been an act of extreme violence, I was just referring to the dynamics of that specific charge. What’s worse re: the extent of the abuse: I looked up the child molestation statute in GA specifically and it appears that age gaps are statutory qualifications for reducing he severity of the charges (misdemeanor vs. felony), so the fact that the prosecution is pursuing aggravated child molestation in spite of that potentially signals that, not only was this sexual violence, but the victim could also be substantially younger than him. Grim, to say the least.
