If franchises like Mario and Zelda still alive and successful after more than 30 years it's because how nintendo cares about their intellectual property, otherwise they would be bastardized franchises like sonic.

That's ridiculous.

If I buy it I can do whatever I want with it. They're within their right to deny any user access to their online systems but the physical piece of hardware belongs to the person that paid $400+ for it. To render it completely useless after sneaking in an amendment to their terms is shady and predatory.

It's bad enough that games you buy online can be taken from you on a whim, Nintendo is trying to do that with physical consoles.

i’ve never modded my nintendo products but am active in communities where it’s pretty common; this feels a bit weird…..and i’ve seen videos about this concept of licensing/subscription based services becoming even more common and it’s scary

No - fact is, for quite some time now the game distributors have been SALIVATING over the prospect of renting out licenses as opposed to providing people with a game copy that you OWN, because that allows them to pull licenses whenever they want and resell the same games at a later date.

And out of all the big distributors, Nintendo is the most egregious one in this regard, as they have numerous titles that can no longer be played UNLESS you resort to modding, and they have on numerous occasions absolutely RUINED lives of people who tried to play/provide a way to play games that are no longer accessible, even though that endeavour was clearly not motivated by money, and did not hurt the company.

You can 'it's their right to do that' all you want, doesn't change the fact that this standard of practice is being forced by distributors for one and one reason only - greed. 

I remember when they basically went to war with Let's Players on YouTube and ended up losing the little PR war they started over people streaming or posting playthroughs of their games.

All the gaming companies pull shady stuff but as far as the really huge ones go, Nintendo has really become indefensible :toofunny: 

I just think if I'm gonna pay over $400 for something, it's gonna be my property. Clearly Nintendo disagrees.

Idk about any other big gaming companies but I know that PS5 sitting on my TV stand is mine to do with as I please.

The only time Sony bricks consoles is if they're stolen and then connected to the PSN.

I have to imagine Microsoft/Xbox is the same way 'cause it's insane to assert that consumers aren't buying a console, they're buying the license to use a console.

TOS are for active services, like online play, networks, and stores. Being able to physically use hardware you have purchased isn't a "service", it's a reasonable expectation.

Imagine if Google or Apple could lock your phone for watching fan videos of a concert on YouTube. That's how stupid this is :rip:

I understand them wanting to prevent piracy, but most modders I know don’t do that, they just mess around with certain aspects of their hardware/software but they don’t illegally download games for free. This feels a bit odd. Like others have said, yes restrict their online access, but to render the whole console useless? Nah, they better be giving refunds if this happens otherwise I see a lawsuit coming

I'm done with Nintendo anyway, so as infuriating as this news may be, we can only make a change if we actively stop buying their products. I gave away my Switch and all the games I had last year, and as long as Nintendo keep up being this insufferable, no console or game of theirs will find its way into my home any time soon. Instead, I will watch let's plays of interesting titles, pissing off Nintendo while doing so :laughga: Not that anything interesting has been announced for the Switch 2 yet :trollga:

just to be clear that this happens only in extreme cases, for example, if you sell modded switches, they will brick all of them the moment they go online.

In most cases it goes with short account suspension - longer account suspension - full one - console ban - console brick.

It's not actually.

Section 12.2 – Suspension or Termination by SIE:

"With or without notice, we may restrict, suspend or terminate your PSN Account and PlayStation Device, or indefinitely restrict, suspend or discontinue your access to or use of certain PSN Content, offerings, features, products and services, if you violate this Agreement or we have a reasonable belief such a violation has or will occur, or as otherwise may be reasonably necessary to protect our PSN users, our partners, our platform, or other SIE interests."

 

imo, gaming has been enjoying the lack of regulations and laws for many years, only the fact the we can't have a proper refund system is outrageous, I've got so many games that I just dislike sitting in my backlog because I couldn't refund them, either force a demo or force a refund.

There are so many problems with gaming and it's sometimes really discouraging to be a gamer.
