SA is hard to prove when you don’t take legal actions IMMEDIATELY and get all the evidence possible. As a survivor myself I salute Kesha’s courage for fighting for so many years but I understand a court case without evidence is difficult to understand for many people. I guess I’ll leave you with Gaga’s lyrics til it happens to you you won’t know how it feels.

So Kesha still could be found to have defamed Luke and she very well might lose. HOWEVER if Luke keeps getting hit after hit the damages caused by Kesha’s defamatory statements won’t be much. Which is really good for her. This could bankrupt her.

It’s also really hard to disprove if false though. This is a debate that won’t end without some sort of subjective view influencing it.

I’m in a minority where I think we want to assume consent is extremely obvious but in reality it’s way more complex and relative. Of course, if someone tells someone else to stop or they don’t want them to do something, then it’s a clear violation. But a lot of scenarios aren’t clear cut.

I’ve been in two situation where I haven’t given clear consent to despite being very receptive at first. But as the event happened I felt uncomfortable and should have said no but let it happen. I perhaps wonder if that’s a possibility in this situation.
