This was a straight up rip off. And yes, Born This Way is too similar to express yourself, beyond the chord progressions.

It wasn’t just the chord progressions, but the melodies and the vocals patterns were exactly the same as Express Yourself. The difference was EY was in a higher key (C Major vs BTW’s B Major).

Not true. Hip-Hop was originally a fun and upbeat form of music. It’s rooted in disco and they used samples from other records; they had to credit them though if they wanted to interpolate, which Tory Lanez clearly didn’t do.

He didn’t use the exact same instrumental and stems, but he copied it note-for-note. It’s an instrumental cover with different lyrics and vocal melody.

yes, that's the couple notes that coincide, also the ones in "i'm beutiful in my way, cause god makes no mistakes" and "if you want it right now, make him show you how"
But it's a reach because that's just melodies from the verse and a post-chorus, if you put both chorus back to back they are completely different. Besides, if anything, those are very common melodies from the disco era, and madonna just used them in her song,  just like she did with Respect Yourself by The staple singers in a less glamorous and blatant way,  these couple melodies are also in the song that actually inspired gaga:

in any case, she still didn't have a case, and she knew it, it's like the guy who demanded shallow for a melody in the prechorus "i'm falling..." he just embarrassed himself and the same would had happen with madonna if she would've take legal action..

And also, there's melodies like that too which coincide in Symphathy for the Devil by the rolling stones in the verses, much more than BTW and EY actually, because it's the whole verses that sound similar, again completely different chorus, but you can easily make a perfectly matched mashup because both songs share the same chord progression even tho they're not that similar, look:

it also have similar melodies in the verses to Waterfalls by TLC etc etc and even more similar with EY in the chorus.

Anyway, the reason it was compared only with EY was because she was already being compared with madonna in everything she was doing, and pitted against her, and then Madonna enjoyed the publicity, took advantage of it and feed it, while Gaga was treated like a copycat for so little, and yet ironically it was the most original thing in the charts as that chord progression never touch the pop world again for years which was innudated with the I–V–vi–IV progression, she brought it back with a completely new and modernized style, while madonna herself at the time was dedicated following trends, i have to say it was all very ironic.

When it comes to Tory's song, it really does sound super similar to Into The Groove. More of a copy and less of an inspiration situation.

Born this way isn’t a direct illegal sample. It’s definetly inspired, but at most it’s similar,  it doesn’t sample- so there is nothing legally MaDONNA could do. Born this way is 100 percent inspired by a mixture of Vogue and Express yourself, but that’s it.

I still don't hear the resemblances istg. I get Madonna did shape and influence Gaga in many ways but BTW shares the same message, self love and empowerment. The songs don't sound the same sonically at all whatsoever imo. I just can't hear it. Other Gaga songs I hear I'm like yeah that's very close to Benny and the Jets or Bowie's Fame etc just not with BTW
