"Attorneys from the Justice Department amended their filing to stress that, while they will defend the law in court, the policy surrounding the federal law is being reviewed by the Department of Education.

The federal law at issue, part of Title IX of the Education Amendments of 1972, prohibits discrimination on the basis of sex in federally assisted education programs, but allows for a religious exemption for organizations with religious objections."

They don't have a veto of federal law. If it's in federal law, they are tasked to defend it. No one should be surprised by this, we have to get legislators to change the law or have the SC find it unconstitutional (which won't happen).

It’s a shame that our society has evolved much faster than the laws and system have. We are in this state because Republicans and some Democrats continue to hold up progress on topics that the US population is very much in favor of. The very same people they are supposed to represent.

Such a sad state to be in when only several hundred people control the trajectory of this country and all they care about is money.

Here's the thing, and this is not a defense of what they're doing it's just a fact of how this works, they don't have a choice but to defend it. They can't just decide which federal laws they do and don't back up. The only way for this to change is if the law itself is changed. That's why your anger needs to not be placed upon the people who've got to defend it, but on the people who wrote it into existence in the first place (the legislature).

This is not even remotely true, and a large part of the reason why our community condemned this so severely is because his Department of Justice literally said that they 'share the same ultimate objective' as an anti-LGBTQ extremist group, Alliance Defending Freedom, in their initial statement (again, a statement that stated they would "vigorously defend" the implementation of a blatantly unconstitutional, bigoted law).

The DOJ is already trying to do damage control and walk back their initial statement because LGBT groups didn't invent excuses for Biden and his administration like you two are attempting to do and blasted him for doing something unconscionable:

"The filing came in a federal lawsuit in Oregon from students at religious schools who are suing the government for providing funding to schools with discriminatory policies. Tuesday, DOJ had said that it will continue to defend it. 

In the amended filing, government attorneys wrote: "The Department of Education is conducting a comprehensive review of its regulations implementing [the law], which sets forth the current administration's policy on guaranteeing an educational environment free from discrimination on the basis of sex."

Stop making up excuses for these right-wing politicians just because they have a D next to their name. Hold them accountable when they betray workers and minority groups instead of claiming that they have no choice but to betray them.

When these cases are brought, you do realize that "V. United States" is the justice department, right? They can't just decide not to show up, their job is to defend the federal law. They don't pick the side they get to fight on, cases are brought against THEM. Once more, Biden isn't in charge at the DOJ. He's already said he would have a completely hands off policy when it came to the DOJ, because Trump trampled that separation. Yes he's ultimately responsible because he appointed the Attorney General, but he picked him specificlly because he WASN'T a partisan. 

I understand you want to demonize me & others, but you're skipping over important details to push a weak witch hunt. I remember not that long ago when you were hounded on this forum for being a Trump supporter, so don't try to pretend like you're suddenly a leftist champion. You do leftists a disservice when you reject nuance & you fall into the same trap.
