they legally have to delay the election. if he dies this close to an election, then we have to go all the way back to the nomination process. Biden would have to be re-nominated and the RNC would have to put forth a new nominee. from there it can be fast tracked but there's really no precedent for anything other than the election essentially restarting.

It wouldn't go back to a primary process, the party leaders would just choose who to put on the ballot. In all likelihood, they would just keep Biden/Harris because that's who the voters chose.

If the election isn't resolved by Inauguration Day then Nancy Pelosi becomes president  and we'd likely have another election after the GOP decides who to put on their ballot (probably Pence and, idk, Romney or some other stooge).
