I think you could argue negligence if Covid-19 awareness was very low, but almost a year into the pandemic that is almost impossible. 

A court case in Germany was ruled similarly last year when an illegal car race ended with the death of a pedestrian: Usually courts would rule it as a "vehicular manslaughter" on negligence, but the case made headlines because the driver is going to serve a life-sentence for murder. They argued: "It is IMPOSSIBLE to not know that illegal car racing in the city at speeds of 200km/h is a threat to human life. If you do this, you willingly accept the possibility of taking somebody's life, which by definition is murder."

I know, but the line between negligence and intent in cases like this is very blurred. Depending on how she acted, it could go one way or the other (at least according to my country’s law, which I believe in this aspect is very similar to German law, since we copied a huge chunk of their penal/criminal code in the 80’s).

This. Idk how it is in the US or other common law countries, but at least according to my country’s law (I believe it’s similar in Germany), if you say “yeah that might infect/kill other people but **** it I don’t care”, that’s intent. It’s only negligence if you say “well I know there’s a risk but I’m being careful despite not wearing a mask so I’m confident I won’t infect anybody”, and if this confidence is minimally plausible/believable.

 

EDIT: there was this very curious case once when a driver was way over the speed limit, and when he saw two pedestrians crossing the street, he accelerated even further, because it was too late to use the breaks, and if he went fast enough he could pass them without hitting them. Needless to say, it didn’t work out and both pedestrians died 

It goes to show how fine the line between intent and negligence is.

Also: the woman in question was awaiting her covid-19 test results and should have been in quarantine anyway.
