The same conscience that would tell the donor to make sure he is recently tested and made sure it is safe to donate. HIV And AIDs, the diseases they are primarily worried about, disproportionately affect gay men. This being this case means that gay men are at a higher risk for carrying these diseases. The reason there was a ban for 12 months was because the typical incubation period of the HIV virus is around 6 months but sometimes longer. Now, does this mean this is okay? Not necessarily. However, we need to realize that these laws don't come only from homophobia (it is a big part of it - don't twist my words), but they also come from actual numbers and science. Additionally, they can't just draw blood and wait for months for the virus to potentially develop and then test.
