Automatically supporting or being against someone without much evidence is akin to witch trial behavior. There is a reason why we have moved past this.

As I said, I am neither judge nor jury. And you're right, there is a reason: we have jury vetting just for these cases so there's no prior bias when meting out justice. I am within my full right to "automatically" support or be against someone. I don't have to change my attitude towards this so long as system exists. I'm not even inclined to think otherwise because I know my priority is kindness and compassion towards the victim.

Seriously ? There is a video of her under oath telling that Dr Luke never touched her. If it's not a lie for you, i don't know what it is !

Im 100% convinced kesha did this out of fear

Y'all realize that 2-8% of reported sexual assault crimes are false, right?

I'm sorry, but I can't get over the fact that some of y'all are like, "Well, maybe she lied". I highly  doubt she did. If any interview, any interaction with someone else, etc. shows anything, it's that she is telling the truth about what happened to her.

"Highly doubt," that's the thing you are not 100% sure. She could be lying and if she did, that is disgraceful. Nobody knows the truth

Okay...

I do NOT understand the following:

I agree that if Kesha posted on twitter or publicly stated that Dr. Luke also raped Katy Perry, can be considered defamation.

BUT!!!!!!! In what world is Kesha's PRIVATE MESSAGE with Lady Gaga "defamation"? What the ****? If I say something to my best friend via text about someone else, it could be used against me as defamation? :deadbanana:  Is it because Gaga is a possible "client" for Dr. Luke (as in could work with him blah blah)...?

Or is it still considered defamation even if you talk to your friend in a private convo? Idgi, sounds ridiculous tbh.

With that said I can see other things being "defamation" apart from the "Kesha told Gaga that Dr. Luke raped Katy Perry", but then again, in cases like this where Kesha was suing Dr. Luke first and where Kesha is in the less powerful position, I think exceptions should be made. Because Kesha has all the right to publicly statethat Dr. Luke raped her (if true) and it shouldn't be considered as defamation (though if someone lies, then it's obviously defamation so yeah it's really... complex issue that can only be solved if there are exceptions for certain cases).

Cited precedent of Lentlie v Egan (1984), "defamation requires but one communication to a single person"
and that the definition of "defamation" is basically telling false information to people in order to have them see that person or company in a negative way.

I’ve said from the start, unfortunately, that I really do feel like she was lying. And I guess the court feels the same way. Something about the way she talked about it and acted made it seem like there were ulterior motives, and once it started getting really serious, she was almost stuck lying.

yeah okay... I mean  this is true, thing is... that how do they know it's "false" information (I am talking generally, in Kesha's case, Katy testified that Dr. Luke did not rape her, so welp.. :rip: ). But in general yeah, it's a bit messy cuz, if you share something with your bf without the intent of defaming them it could be used against u..? :rip: ).

Her claiming Dr. Luke raped Katy was the dumbest move she did. And really ruined her credibility.

How dare she share something to a friend she heard from what she thought was a reliable source.

yes exactly, under the law, publication is defined even as telling one person, because you've "damaged" that other person's reputation.mp3

I don't think she wanted it public though...  remember Luke/s side demanded for Gaga and Kesha's mssgs to be released :rip:

I find it weird that some of you act like it's impossible for women to lie about rape. White women have lied about black men assaulting them and we know what happened after...

Nobody is saying it's impossible. Just that that it's, statistically speaking, less likely.
