Didn't he do that with Syria a few months ago? https://www.cbsnews.com/news/house-panel-approves-amendment-that-would-strip-trumps-war-authorization-powers/ Ah pardon me I got the thing kinda wrong...the post 9/11 bill (which was repealed) allowed the prez to declare war on anyone who might have had something to do with the attacks (though knowing the US they could pull some BS story out of their asses and blame NK), but as the commander of the army, he can easily send troops without approval (like what happened in Vietnam and Korea). The 9/11 bill did cause Iraq and Afghanistan though since they were suspects and all, but he'll need congressional approval to OFFICIALLY declare war against NK.
