It is a federal issue for schools under Title Nine. No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance. Under Title Nine, SCOTUS could have very easily considered it a human rights issue. States rights is a terrible excuse when it comes to civil rights and protections, no matter how small the minority. It wasn't going to SCOTUS to be determined if it could be included under Title IX. It was going to SCOTUS because states were suing the Obama Admin. for threatening to withhold federal funding if they didn't comply. If you want transgender rights to be included, amend the law, don't try to jam it through the presidency or else you'll run into a situation like this. As I originally stated, it was going to SCOTUS because Obama was making it go there by enforcing the protections that already exists under Title Nine. Considering Title IX was passed in 1972, I don't think it was every meant to encompass transgender rights given that transgender people barely existed then. SCOTUS (especially with its current composition) wouldn't have upheld Obama's order and it would've been a devastating blow to trans rights. Just trying to see a silver lining here... Do you really think SCOTUS would label the trans community as a protected class? They haven't even labels gays and lesbians as a protected class.
