White House OKs Discrimination Against LGBTQ+

WASHINGTON ― White House press secretary Sean Spicer gave a clear indication Tuesday that the new administration will not be a forceful defender of transgender rights, saying President Donald Trump believes that issue should be left up to the states. 

 

The Trump administration is reportedly preparing to rescind a policy issued by President Barack Obama’s administration mandating that any school that receives federal money must treat a student’s gender identity as his or her sex. Schools, for example, would therefore have to allow transgender individuals to use the restroom that corresponds to their gender identity, rather than the sex assigned to them at birth.

 

“The president has maintained for a long time that this is a states’ rights issue and not one for the federal government,” Spicer said. “So while there will be further guidance coming out, I think that all you have to do is look at what the president’s view has been for a long time: that this is not something the federal government should be involved in. This is a states’ rights issue.”

Abortion has been a controversial topic for years. Some approve and others don’t. It’s a mostly even split. That aside, it is almost always the woman’s choice whether she gets an abortion or not. Now in Oklahoma, that isn’t the case. A new bill has been passed in the state that requires women to get written permission from the father of the child before an abortion can be carried out.

“I understand that they feel like that is their body … I feel like it is a separate — what I call them is, is you’re a host. And you know when you enter into a relationship you’re going to be that host and so, you know … take all precautions and don’t get pregnant. … After you’re irresponsible then don’t claim, well, I can just go and do this with another body, when you’re the host and you invited that in.”

This statement comes from Oklahoma State Rep. Justin Humphrey, who created and advocated for the bill. Even with exceptions granted for cases of rape or incest and dangerous pregnancies, this bill and Humphrey’s words are wrong on many levels.

Lol it's always been up to the states. Transgender bathrooms in schoosl is not within the power of the president, nor should it have ever been.

You realize that this executive decision was only in place for like the last 5 months right?

This is what you get when you make policy through the executive branch; it can always be overturned with the stroke of a pen.

The executive branch should not make policy not granted to it in the Constitution, nor does it have the "Power of the Purse" to restrict federal funds. That is expressly given to the legislative branch.

The case was going to be heard at the Supreme Court on March 28th, but because of Trump's reversal, the SC may very well send it back to the lower courts. Obama was forcing it to be heard at the Supreme Court level, which could have found that it was under the protections of Title Nine. 

The "states rights" line is often used as a way to discriminate and restrict rights and is apparent in this case and many others. Title Nine, that gaurds against sex discrimination, is what makes this a civil rights issue...not a federalism issue.

Oh, but do you see how mandating each state make accommodations to allow people to use bathroom that match their gender identity?

Look, I am all for transgender/gay/lesbian equality and I hope one day soon this community as full rights, but transgender bathroom is just clearly not a federal issue.

All other powers not listed here shall be given to the states. The founding fathers never intended for this to be a federal issue, and scotus would have surely shot it down anyways.
