Erotica 34,929 Posted August 14, 2016 Share Posted August 14, 2016 The Constitutional Court has ruled to annul a provision that punishes all sexual acts against children under the age of 15 as “sexual abuse,” stirring outrage from academics and women’s rights activists who warn that the decision will lead to cases of child abuse going unpunished. The Constitutional Court discussed the issue upon an application from a district court, which complained that the current law does not discriminate between age groups in cases of child sexual abuse and treats a 14-year-old as equal to a four-year-old. The local court said the law does not provide legal consequences for the “consent” of victims in cases where the child victim is from 12 to 15 years of age and able to understand the meaning of the sexual act. “This creates an imbalance between legal benefits and sanctions that should be preserved in crime and punishment,” the application stated. They won't cause of the refugee deal with them. Turkey would flood europe with the refugees and that is where EU leaders are afraid off. Stupid if you ask me. I am not sure why the age category matters, would it make it worse for children or less problematic for 12 years and above? AlphaMonster 1,806 Posted August 16, 2016 Share Posted August 16, 2016 Clarification: Age of consent is still 18 years old in Turkey but sexual relations with under 15 years old was accepted as a rape/sexual harassment directly no matter the age of offender. Because of this law, 16 years old having sex with 15 years old was a crime as big as 40 years old molesting 4 years old. An example: You are a 16 years old guy having sex with the 15 years old girl where both parts have consent. Unfortunately, traditional law sees penetrator in sex as the predator. There were cases in which family of the 15 years old girl (or bottom gay) found out about her/his relationship with this other 16 years old boy, and this family was actually able to send the 16 years old boy to juvenile prison because of this law, literally ruining his life. This is given as the reason why constitutional court ruled the law. But there should be another law concerning this issue with more layers. Although from another perspective, a 40 years old child molester can argue that 14 years old he/she molested had consent... First argument is given as reason to abolish the law. But I hope that they would make a law instead to close the stupid loophole that can cause second case (one with 40 years old man) to happen. But again, the law that has been ruled was ridiculous though; I am only scared that it would benefit actual child molesters... On the other hand, 14 is age of consent in Germany while a 16 years old could be sent to jail for having sex with a 15 years old because of this stupid law that has no layers whatsoever.
