A 23-year-old Egyptian studying to be a pilot in Southern California will be escorted back to his home country by immigration agents after he posted on Facebook that he’d be willing to kill Donald Trump.

Emadeldin Elsayed will remain in Immigration and Customs Enforcement custody as the government makes arrangements for his departure, agency spokeswoman Virginia Kice told BuzzFeed News. A judge denied his request to be released on bond while he awaits his departure at a date that officials would not confirm.

It’s a move that has left Elsayed and his attorney dumbfounded. Facing formal deportation proceedings, Elsayed agreed to leave the U.S. voluntarily, his attorney, Hani Bushra, said. But instead of getting on the next flight to Egypt, he’s waiting in a jail cell while the U.S. arranges an escort.

If the government believed Elsayed had committed a crime, they should have charged him with one, Bushra added, not pressured him with challenges to his immigration status.

“The use of the immigration system as a punitive measure is kind of disturbing,” he said. “But it’s a new trend.”

It's unfair, but making a criminal threat while being under immigrant/visa status is not the wisest of things to do.

He was probably already under watch just for being Egyptian, but then you go and make a public threat of violence..? Not good.

Freedom of speech does not mean threating somebody life is alright, get some extra brain cells or something?

The Secret Service is a federal law enforcement agency under the U.S. Department of Homeland Security. They must have thought there were reasons to deport this guy. Oh well, he can go get his flight training somewhere else.

"Freedom of Speech" does not give you the right to make a death threat against anyone.

In Chaplinsky v. New Hampshire (1942), the Supreme Court held that speech is unprotected if it constitutes "fighting words". Fighting words, as defined by the Court, is speech that "tend to incite an immediate breach of the peace" by provoking a fight, so long as it is a "personally abusive [word] which, when addressed to the ordinary citizen, is, as a matter of common knowledge, inherently likely to provoke a violent reaction".

Threats of violence that are directed at a person or group of persons that has the intent of placing the target at risk of bodily harm or death are generally unprotected.
