I agree. While I believe Kesha and think Luke is scuzzy filth, accusing someone of rape is very, VERY serious. Sure, it's nowhere near as bad as actually being raped and the psychologically and physical scarring of the ordeal, but (particularly professionally) it can have seriously bad consequences on an innocents life. An accusation with no facts present is completely (and legally) irresponsible to do so. We should tread carefully.

Also while I don't doubt the sincerity of many on here toward Kesha's situation (particularly those that have been victims of abuse themselves - my heart is with you guys), let's not pretend that if Kesha was a Z-list performer with zero celebrity support in the exact same situation that some people on here wouldn't be calling her bitter failure trying to get publicity by taking it out on everyone's favorite bop master in order to get out of their contract. This is the real reason why so many don't speak out. It's lucky Kesha already has so many fans to support her, but there are many Kesha's out there that in this exact situation would be targeted for attack by the public if they didn't have name recognition. And not just women either. These are some things to think about guys.

Now as far as the judge is concerned, I would think at the very least that there is hard evidence the man is incredibly unprofessional with his clients and we even have claims of verbal abuse by others he has worked with. Wasn't there a deposition Kesha had to testify at to defend him awhile back? I'd like to know more about that. If this were any other job this man would be fired and likely sued for harassment and unprofessional conduct. I'm not sure why he is being given a pass here. I don't know the legal boundaries but I wonder if the judge couldn't have ordered Kesha to continue working with Sony but terminate the contract with Luke, or had her buy her way out for a percentage of the contracts value. I think that would be very fair given what evidence is available and if he wanted to whine about that he could be reminded that his brand of sleaze would NOT be tolerated at any every other job in any other industry out there. It would serve as a good compromise, I think. Sure, it may not be what Kesha had hoped for but it would keep him away from her and Sony could still get their money. She could happily work with a different producer or two in a much more productive and less stressful environment. It would also serve as a lesson to producers to start behaving in a professional manner with their clients and keep unwanted comments about their weight to themselves. This is a job, they are being paid, that is their coworker, and that constitutes harassment in every employee guidelines manual out there. Straight fact.

A court doesn't decide if Kesha was raped or not, she only knows it and it's obviously he's going to say he didn't do it.

So what's your alternative? We just presume every man accused of rape is guilty without evidence? 

In most cases of rape, there isn't any physical evidence, and it usually comes down to one person's word against another person's word. If it cannot be proved beyond reasonable doubt that a rape took place, then the jury has no other choice than to reach the verdict of 'not guilty'. That is how our justice system works for every crime, and rape is no exception to that; the presumption of innocence until proven otherwise is the cornerstone of a fair and just society, and long may it prevail.

The legal court can find him innocent and thats great for him.

But the court of public opinion is valid as well, because we do have flaws in our legal system

I think a perfect representation of what I'm referencing is the OJ Simpson case. The court found him innocent, but the majority of people say he's guilty. 

Evidence must be beyond a reasonable doubt and in some cases, thats a really strict standard to be able to prove that someone is guilty.

The thing here is that Kesha wants to break her contract with him and Sony. They're no letting her make music, she's a musician, it's her life. Even without the contract Luke's influence can destroy what last of her career.

He said 'I invested $60m on her career' while Kesha saw her career been destroyed and a judge ruling in favor of a man because of a contract and money, come on, let her go.

Kesha isn't even pursuing rape charges, right? All she wants is to not work with him but still have the same rights. She'll record under Sony, get the promo she deserves, and put out the music she needs to. Sony gets their money either way, so I'm wondering why they're pushing so hard to have Luke in the equation? I'm sure they have at least one other competent producer...

only way they can prove actual rape is by having medical report which at this point is impossible. So just because they can't get that he is innocent? just because there is no evidence doesn't mean people don't have brains and don't have right to pick their sides.  

And Kesha is aware it will be hard to prove he raped her cause she doesn't have medical report, and that's why she is asking just to be free.

She did file for sexual assault, battery, sexual harassment and gender violence in a Los Angeles court. She later amended it with an injunction against Luke and Sony as well in a New York court (claiming that Sony knew of his behaviour and didnt do anything) to break from contract, so the LA trial was put on hold until the NY trial was finished (that happened recently).

The sad thing is: she is signed to Sony and RCA trough Kemosabe Records, Luke's very own label. And the music publishing rights of her songs belong to Prescription Songs, Luke's very own publishing company. So she "belongs" to Luke just as much as she belongs to Sony. Both Sony and Luke will "loose" the potential money she would make for her next albums within contract. Apparently, the judge ruled against Kesha because the contract was the typical musician contract and they couldnt break it without any proof, plus the fact that Luke's defense offered that she can fulfill the contract with Sony without Luke's involvement, but with Kesha still signed to him. So they dont meet, but he is still the boss. She would still be immersed in that toxic environment.
