Yes, she would be sued...and it wouldn't be a fine, it would be for millions. It would also hurt her case for getting out of the contract permanently, which is her goal. 

But i don't get it why doesn't Luke cut her off , if they hate each other they will never work together so what's the point and when will things conclude 

do you have any idea ?

Because he wants money or wants to see Kesha suffer and have her career disappear. That's basically it.
