Would be pretty strange and borderline nonsensical if they ruled against, basically contradicting their earlier ruling They never ruled against it. They ruled against very specific language in a California voter referendum that outlawed same s-x marriage after the state legislature already made it legal. Exactly, now why exactly would they do so? They already deemed it unconstitutional to deny Gays the right to marry, we got this in ths bag! That's not even somewhat accurate.... I dont see any reason why they wouldn't say yes. But, I don't want to bank on anything yet. I just hope for the best. Because the US Constitution doesn't say anything about marriage and the Constitution also states if it is not specifically written in the Constitution then it should be left up for the states to decide. They dodged the bigger question to try to stay out of it so as not to be seen as activists which led to a ruling that left the issue of gay marriage up to the states. If you are saying I'm wrong because that wasn't their specific argument, who actually cares what their argument was except for law students? The SC is split down the middle with extremely conservative judges and extremely liberal judges that almost ALWAYS issue their rulings along party lines. There's one (arguably two) judges that are considered moderate and act as the "swing votes", if you will. This is it, we could have equal marriage rights throughout this entire country by June Because the US Constitution doesn't say anything about marriage and the Constitution also states if it is not specifically written in the Constitution then it should be left up for the states to decide. Yes, you're on the right track! But just remember that only a handful of states have actually passed same-s-x marriage through their voters. The vast majority of states that allow gay marriage right now do so because their highest state court deemed it illegal to deny same-s-x couples the right to marry. If they SC decided to rule against this case, all of those lower state ruling would be overturned. There's no way there saying no this time around. It made it arguably THE single most controversial SC ruling in all of US history and it led to dozens of abortion/women's health clinic bombing and shootings....
