AN X Factor contestant who claims he was set up as this year’s “joke act†has become the first to sue the show.

Adam Miller claims bosses tricked him into singing for the judges so they could humiliate him in a bid to boost ratings.

The 27-year-old, who previously appeared on Britain’s Got Talent, did not apply for The X Factor but says researchers bombarded him with tweets and phone calls for weeks, ­promising to make him the new Rylan Clark.

But at the Manchester auditions two weeks ago he says they sniggered as Cowell shouted: “Why did you apply for the show? You can’t sing! I’m sick of your sh*t, get off my stage.â€

Adam was so distressed by his public ­humiliation he was taken to see the show’s counsellor, and later demanded producers cut his audition from the show.

He said: “Real people are getting hurt. It needs to stop and people need to know.â€

He is now claiming damages from ­Freemantle Media, which produces The X Factor and BGT, and Cowell’s production company Syco Entertainment.

He said: “I’ve been lied to, manipulated and used by the show and I can’t be the only one. It might be Simon Cowell and it might be the X Factor but that’s wrong and I’m not going to let them get away with it.

“They approached me. They gave me a bit of self confidence then cruelly and deliberately stripped it away to make good TV.â€

Adam reached the final 100 of BGT in 2010 with his comedy Britney Spears tribute act – as a female ­impersonator, not a singer. He claims X Factor researchers contacted him on Twitter and by phone in March, offering to “change his lifeâ€.

He said: “On BGT, I knew exactly what I was doing. I went into it with my eyes open and it was supposed to be funny. When the researchers from The X Factor contacted me I said ‘no’. I don’t have a good voice and I thought it would be humiliating. They tricked me and told me I’d make a career out of it.â€

In one email, a researcher told Adam: “The producers want to see you as an entertainer, someone that can put on a great show. You really wouldn’t be embarrassing yourself.â€

Adam claims a show producer told him on the phone: “You’re going to be this year’s Rylan Clark. This is an opportunity of a lifetime.â€

But he now thinks he was being set up as a joke act like 49-year-old Goldie Cheung – who wore skimpy outfits and wrapped a leg around judge Gary Barlow’s neck in her 2011 audition – and Debbie Stevens, who threw a glass of water over the panel in 2008.

Adam says he was told to wear the red Britney circus outfit he wore on BGT and bring all his family and friends.

He said: “I really thought it was going to be my moment. Looking back I feel a fool. This is their job – to get people who will give the audience a laugh. To do it without letting the acts in on the joke is just cruel, though.â€

He said Cheryl Cole “looked like she was going to cry, she felt so sorry for me†in his audition at Old Trafford Cricket Ground last month. “But Simon seemed to enjoy laying into me. They clearly think it makes good TV.â€

Adam’s legal fight comes after girl group Viva Pitch yesterday told how they were left devastated by Cowell’s comments about their singing. They say the show’s talent scouts hounded them to take part. The five girls – aged 16 to 22 – had previously only sung to a backing track yet they claim they were scouted by the show over four months.

The guy should have known what he was doing tbh :emma:
but if the X Factor like pressured him into doing it, then  :wtf:  that's awful on their part.

finally. clearly half the people that are supposed to be the joke of X factor are vulnerable and/or have learning difficulties. The show exploits that for cheap entertainment.
