Kavinsky says Gaga rip-off his song

Ok, so I watched the whole performance now.

I was addicted to Nightcall (Kavinsky's song) when it was released, which was a main theme song for movie Drive with Ryan Gosling. It is not horror, but dark drama/mystery/crime and I'm reaching, but there are good chances Gaga watched that movie.

The synths/beat is difficult to know is the same, the few seconds sound exactly same, but the main "spiraling" sound is gone/not hearable due to other sounds in the performance.

But then when Gaga sang with that robotic autotune sound, that's what makes it almost rip-off. Like not only the beat anymore (at least the first seconds it has that guitar riff that later is not hearable) but also the actual vocal effects to it.

I'm sure Gaga would credit him, but either she never knew, or she forgot about songs existence. Interesting that her latest collaborators, which would like Kavinskys song, electronic and robotic including guitars, didn't inform her about the similarities.

I unfortunatly understand that Kavinsky is reacting online. It's quite a good song, that deserves credit honestly. Yes, maybe he was inspired by Daft Punk sounds (with Manuel in Daft Punk helping with production actually), but at the end of the day it is his original song.

Other explanation is as someone else said here, that he doesn't own the rights to the song anymore or something. Put it like this: if she used a song from a known artist like this, why not credit? I mean, Gaga likes to credit peoples art usually. Hopefully it's a misunderstanding.

I don’t know this man. I don’t know this song, but you guys always let bias win in these cases. It’s obvious that she was inspired or wanted to reference his song. Some of you clocked it immediately, and were happy about it.  Even ChicaSkas said it in her notes of the live show back in January. Now that he’s (disrespectfully) speaking out about it, none of you hear it?

I don’t really think anyone said they didn’t hear it, tbf. People just questioned whether it was a direct interpolation as opposed to an homage (à la the homage to Bowie’s Fame in Killah)

Coming out of GagaDaily retirement for this one.
Having someone essentially take what you made and use it without your permission or credit for an album that is available to stream by millions of people is kinda lame, no two ways about it. It's not pitchfork worthy, she isn't a terrible person for not giving credit where credit is due. Her legal team has no excuse though, they had four months to reach out to either Trent or Kavinsky + Guy-Manuel and at least put a proper credit for what they used.
"Well he should've reached out in private", well her team should've reached out in the first place.
"Well, he's getting his bills paid", no nerdbob, there isn't a credit so he gets zilch.
Ohhhh that one message "you're lucky she's giving you a bit of exposure you ungrateful old" is soooo **** because it can't count as exposure if there isn't a credit of any of the production crew for Nightcall in earshot listed in Apple Music metadata.
And Gaga stans getting bold saying oh well he's smaller and a who so who cares, shame on you. Just because someone isn't a megastar doesn't mean their contributions to music aren't equally valid and appreciated, you can put bias aside and say Gaga made a single mistake, simple as that.
Even if it wasn't intentionally an interpolation, the Closer line of "I wanna **** you like an animal" is, she didn't write that or come up with the idea of that lyric and it isn't even listed in the Apple Music lyrics.
But even with all of that, it's not an entirely big deal. No one is gonna sue or make a problem of it other than the fact Kavinsky just expressed disappointment in having no contact about this whatsoever.

Gaga’s team didn’t need to give him the heads up. That would have been an extra courtesy, but almost 100% of the time artists DO NOT handle approvals for interpolations or samplings of their own music. That’s the labels or publishing company’s job, and since most artist signed off their work to them, they don’t need artist approval to allow for others to use their work. It’s very common for artists to discover a song of theirs has been used by someone else. Everything before that was most likely handled by their label. A cute heads up is nice sure! But that fall under the artist’s label or publishing company’s responsibility, not Gaga’s. If it’s true Gaga is directly using this song, then It’s more than likely Gaga’s team asked for permission, got the approval and went on with their day. Whoever approved the sample should have been the one telling Kavinsky the heads up.
