Because the entire conclusion of the report is summed up by Section 3 of Hur's report. 

Section 3 is titled. "The evidence falls short of establishing Mr. Biden's Willful retention of the Classified Afghanistan Documents beyond a reasonable doubt". 

The President can not be charged with any offence by any body except High Crimes & Misdemeanors by the House of Representatives during their term as President. 

Outside of an impeachment - and there's no evidence to support one. 
This case would never get to trial because by the prosecutor's own admission, he has no evidence. No Judge in any court would accept a prosecution case without evidence. It would be a waste of court time & could be construed as a malicious prosecution which puts the prosecutor at risk of repercussion.
