Taylor Swift asks court to toss ‘Shake It Off’ suit

Taylor Swift wants a federal judge to dump his recent ruling allowing a copyright infringement lawsuit over her hit song “Shake It Off” to proceed to trial.

She argues in a new court filing that the judge failed to address something called the “extrinsic test” when he decided Dec. 9 that the two songwriters who claim she stole their lyrics and concept had presented a “genuine dispute” that should be resolved by a jury.

In the new defense motion filed Dec. 23 that asks a judge to reconsider his ruling, lawyers for Taylor Swift and her publishing partners say the “extrinsic test” and established Circuit law “mandate” that the court focus only on protectable elements while filtering out and disregarding phrases in the public domain.

“Both works use versions of 2 short public domain phrases — ‘players gonna play’ and ‘haters gonna hate’— that are free for everyone to use,” the new motion states, arguing that while both songs also use repetitive phrases called tautologies, those aren’t protected either.

“The presence of versions of the 2 short public domain statements and 2 other tautologies in both songs — a commonality that the court has noted — simply does not satisfy the extrinsic test. Otherwise, plaintiffs could sue everyone who writes, sings, or publicly says ‘players gonna play’ and ‘haters gonna hate’ alone with other tautologies. To permit that is unprecedented and cheats the public domain,” the new motion argues.

A hearing on the request for reconsideration is set for Feb. 7 in Los Angeles.

her lyrics are literally “players gonna play play play and the haters gonna hate hate hate” they’re some of the most generic lyrics so she’s absolutely 100% in the right but honestly a lot of the lawsuits imo in her past  came from her record label more than anything. We know how extra they are

She's right and I hope she wins.  Commonly used phrases should be allowed.  Gaga's lyrics have many, such as "I'm a winner",  "I'm a loser", "I've had enough", "I love you", "I'm a believer" just to name a few.  Wow, imagine the impact on music if she loses this.

it’s not public drama ? it’s her issuing a official court statement in response to getting sued  sounds like you need to relax a little

it’s official court documents that are legally released to the public that news sources then report on.

She is not turning them to ”public dramas”. These are official court documents, where she is supposed to defend herself and answer to these accusations. You just sound like a bitter hater.
