A federal judge has ruled that the U.S. Air Force is mostly responsible for a former serviceman killing 26 people at a Texas church in 2017 because it failed to submit his criminal history into a database, which should have prevented him from purchasing firearms. 

The 26-year-old gunman, Devin Kelley, killed himself shortly after the attack, the deadliest mass shooting in Texas history.

In his decision, Judge Rodriguez said the Air Force bore 60% of the responsibility for the shooting

Devin Kelley had served nearly 5 years in the Air Force before being discharged in 2014 for bad conduct, after he was convicted of assaulting a former wife and stepson, cracking the child’s skull, which should have barred him from legally buying a gun. But the Air Force never entered his conviction into the National Instant Criminal Background Check System.
