Supersonic 49,376 Posted March 19, 2021 Share Posted March 19, 2021 Yesterday a German high court in Schwesig has ruled that the non-consentual removal of a condom during sex constitutes the criminal offence of rape. Back in November 2020 a lower court ruled that "stealthing" does not constitute any criminal offences and aquitted a man who admitted in doing so during sex. The victim and the district attorney appealed the decision and the case was ruled in their favor. Now the case goes back to the lower courts to decide the degree of penalty the defendant will receive. She consented to have protected sex with someone who proceeded to remove the condom beforehand, and when she told him no, he then forced himself on her condomless, saying he wanted to get her pregnant so she'd never leave him. She filed a report with the police but chose not to press charges for various reasons, but she did make the dude drive her to get Plan B the next day. I don't know how it would be proven if there was not a consequence (STD transmission, Unwanted Pregnancy) and the accusee refused to come clean but regardless, it's good that the precedence is being set to show that stealthing is not okay.
