“BORIS Johnson is willing to launch legal action to stop a vote on Scottish independence, Alister Jack has said.

The Scottish Secretary insisted the UK Government will reject any calls for indyref2, regardless of the result of the Holyroodelection.

The Tory minister also said any ballot that’s not signed off by Downing Street will be challenged in the courts.

"Nicola Sturgeon doesn't speak for Scotland,” he told the Express as he talked up his masterplan to save the Union, which involves using British branding on Westminster-funded projects in Scotland.”

He can't though. That would be a breach of the act of the union which dictates that English law does not supercede Scots law.

The tories have broke the law 3 times since Bojo came to power in 2019. Its such desperate tactics. Allister Jack squirms me up the wrong way.

Yes but in this case, if he were to go to yhe courts, the Scottish courts would see the act of the union as being broken. And when that happens the UK won't exist as a political union anymore, meaning Scotland wouldn't need a referendum or anything like that to be independent. It would also cause chaos for Wales and Northern Ireland. 

If he breaks the law on this, then he'll cause the break up of the UK. The Scottish Courts will overrule it and if Boris still doesn't value the act of the Union, Scotland has every right to just walk away since the 1707 act isn’t vaild anymore. He'll be reminded of that by the SNP MPs yet again. They brought a motion in Westminster that asked if the Government agreed with the 1707 act of the Union with regards to English Law not superceding Scots Law, and it passed in 2019.

The Scottish Government can hold a referendum but it won't be valid unless authorized by UK Parliament because this the constitution is a reserved matter.

It is being appealed right now in Scottish courts to see if Holyrood can legally hold a referendum without the section 30

It will be interesting to see where that goes. I don't know the common law but at face value, the legislation seems very clear.

I am seeing more and more this is not a union of equals. Here’s hoping Bojo does this and he unintentionally breaks down the union. It would be great to see.

I really don’t see how Bojo will stop a referendum. If they are a demand by the Scottish people for another referendum they will be one.
