Taylor Swift sued by Evermore Park CEO over copyright infringement

Ken Bretschneider, who created and owns Evermore Park located in Pleasant Grove, Utah, claims Taylor Swift is profiting off a project he invested years and millions of dollars into promoting, according to court documents. www.scribd.com/document/493152047/T-Swift-Lawsuit

The park was founded 3 years ago and celebrates medieval villages, myths and legends.

The Evermore Park CEO furthered that Google searches for his attraction have been overshadowed by Taylor's album, causing "actual confusion" online and alleges he "lost control over [Evermore Park's] reputation" as a result of Swift's actions.

He is seeking an unspecified amount of damages, but is requesting "$2,000,000 per counterfeit mark per type of goods or services sold, offered for sale or distributed."

Swift's team called Bretschneider's claims "baseless" and also inferred that his suit is rooted in greed.

Honestly I wouldn't be surprised if the lawsuit is a means for publicity for the very reasons they stated. My friend lives out in Utah and has been to Evermore a few times - it's a great park, but it only just started taking off. Combine a pandemic and then being buried by Taylor releasing Evermore and creating competition in search results - it really can be impacting their business more than expected. I doubt they will win the case, but I understand why they have brought it.

The park looks kinda cool, to be honest. Taylor would probably love it. 

Anyway, there's no copyright claim here. 

No one can copyright a word.

The Evermore Park will probably own a number of trademarks in relation to 'Evermore' in the context of theme parks. 

But Taylor has released an album called 'Evermore'... not a theme park. 

There's no claim unless The Evermore Park own a trademark for 'Evermore' merch... but even then, Taylor Swift merch is Taylor Swift merch... not Evermore merch.

also, the entire case is kinda built up on them claiming Taylor is, first and foremost, an actress, and not a singer lmaooo

Every Joanne has to sue Gaga for using the name. I think this is totally random. This is just an album name. They should work with Taylor to get permission to use her album as promo for their park. Btw should Coney Island sue Taylor for making a song called Coney Island or New York for being used in million of songs?
