Donald Trump has announced that the US will withdraw its support for a United Nations treaty regulating the multibillion-dollar global arms trade.

Addressing the National Rifle Association (NRA) in Indianapolis, the president said he would revoke America’s status as a signatory of the arms trade treaty regulating conventional weapons including small arms, battle tanks, combat aircraft and warships.

“My administration will never ratify the UN arms trade treaty,” Trump said. “We’re taking our signature back. The United Nations will soon receive a formal notice that America is rejecting this treaty.”

Trump added: “Under my administration, we will never surrender American sovereignty to anyone. We will never allow foreign bureaucrats to trample on your second amendment freedom. I’m officially announcing today that the United States will be revoking the effect of America’s signature from this badly misguided treaty.”

The US signed the treaty in 2013 but never ratified it. The NRA has long claimed the treaty poses a threat to the second amendment. On Friday its members stood, applauded and chanted “USA! USA!” as Trump signed a letter to Congress halting the ratification process, then tossed his pen into the crowd.

This would simplify it too much. There are dozens leaders which are even worse than Trump. The UN has a lot of problems and not all of them are by the US

Just had an exam on international law this Friday I can sum up what might be important to this topic.

 

So there'a different kinds of sources of international law and treaties are only one of them. You can, for example, not ratify a treaty on Genocide but that doesn't mean that your state can commit a genocide without legal consequences. So you have jus cogens norms, which are deemed so important that you can't escape them (genocide, war crimes, etc), you have erga omnes obligations which are responsibilities to the international community as a whole (overlaps with jus cogens norms, but not all erga omnes obligations are jus cogens norms) and you have customary international law. For a norm to become customary intl law there needs to be state practice and a belief by states that it's the way it should be done. State practice/acceptance can be reinforced by a treaty if it gets a lot of states who sign it (near unanimity). So if a judge decides this becomes customary international law anyways, the only way for the US to reserve itself of its obligations is by persistently objecting to the emerging rule of customary international law. This means that if a future administration chooses not to object the emerging customary rule and it becomes an established rule of intl law, the US can be held responsible based on the treaty. Then the US could also just ignore international law and ignore court rulings of international law bodies like Israel has done tens of times, but it does make your international standing lower. Israel gets away with illegal actions because they're backed up by the US. Same with the US (e.g. the illegal Iraq war). The excuse that the UN is anti-Israel because the General Assembly consists of many states who aren't pro-Israel, is weird. The General Assembly barely has any powers, their function is to recommend and their actions are non-legally binding.
