You see videos of other countries where cops are actually being threatened and they handle it accordingly. Honestly, it's kinda of sick & twisted if you think about it. They woke him up/startled him, knowing very well that if you fall asleep next to a gun and get apruptly woken up you will instinctively grab the gun just to reduce the chances of somebody using it against you or potentially stealing it. He wakes up, grabs the gun instinctively not knowing what's going one and gets shot as soon as he gets out of the car because "oh noez! he had a gun! probably means he wanted to shoot us, this was self-defense!".
