As I said in Kuwait you can't be prosecuted for being gay, you can be for engaging in homosexual behavior.

Yeah thats how it is everywhere. But like wouldn’t it be easier for them to lock you up if they wanted to? I mean even on false charges?

as I said it doesn't suffice to have a video or image leak, as per Shari'a law there must be the obligatory 3 (4?) witnesses testifying under Islamic oath that they confirm/support whatever accusation was something that occured in their presence and awareness.

I never said anything suggesting anything of the sort, simply certain distinctions between the 2. Please don't take what you read and infer baseless assumptions.

Well, I asked about the differences between the 2 situations. I didn’t assume that you thought it was better/worse. Read again. Being rude is not always cool.
