There's a difference between creating gay art and creating art for gays. If this couple comes into a shop and chooses a cake design that the baker has available to any couple and there's no distinctive gender elements either way and the baker refuses, then the baker is discriminating against gay people. If the gay couple proposes a cake design that depicts two grooms embracing, for example, or even their names, then the baker could claim the "creating gay art" argument.

A wedding cake is typically just a cake. It isn't "gay or straight". :)

From my understanding, the artistic part of the argument didn’t really (supposedly) have to do with whether a cake is advocating “gay or straight”. That part of the lawsuit was quite literally about his right to basic artistic expression. If he views making these speciality cakes as artwork - which he does - then it might fit under the category no matter what is or isn’t on the cake.

Let me also be clear - I’m not saying I’m happy with the outcome, but I’m not surprised he won.

I agree with you actually. I don’t want to sound whack but like if me and my partner went to this person and they turned me and her away, I definitely wouldn’t take them to court. I would be ****ing pissed and let people know not to buy cakes from them but ultimately I wouldn’t want that person having access to my friends or my dollar (power). So it’s kind of difficult but as a response to the op discriminating based on race is something that would be looked at totally differently. Although, I suppose someone could use religious freedom as a stance if they were in the KKK or something. I just don’t understand why these people with anti-social attributes keep exposing themselves.

REALITY

I know I know. I wasn't saying that fundamentally it shows what he thinks

Its just that when someone said "why are people more sore over racism than this" I was trying to point out there's a bit of a difference

Cuz extreme racists who dont want blacks in their shop don't want to serve them period cuz they are black

But In this case he could be one of those people that will respect them in general over all despite not agreeing with homosexuality and only refuse if a service is for that nature specifically

Maybe because I know so many religious people personally in my family and work I'm more used to seeing the difference

Most of them if they don't agree with some aspect of a person's life (it doesn't apply only to homosexuality btw) they won't want to get involved with whatever aspect they don't approve of but then other than that they treat you and respect you overall

With The type of racism that was being described you would not get that

That's why in my opinion it's not quite the same thing

I understand, I mean, I know religious people too, and they're phenomenal people. We may have differences of opinions on certain issues, but overall they're great people.

I also understand that there is some level of difference when it comes to ignorance. Like I said, this baker didn't beat up the gay couple and throw them out, and in fact, in interviews, he seems very calm and collected.

That being said, the issue I have is that even if it isn't explicit, homophobia is still an issue. The fact that he's denying people because of who they are is an issue for me. Again, I understand the difference between this case and a sit-in in the 60s and 70s, but like I said, it's a matter of principle. It's the principle that he's denying people because of who they are, not necessarily how he goes about doing that.
