Gaga:5F2 to receive limited theatrical release

Ok so official Oscar eligibility requirements state:

"Films that, in any version, receive a nontheatrical public exhibition or distribution before their first qualifying theatrical release, will not be eligible for Academy Awards consideration. Nontheatrical public exhibition or distribution includes but is not limited to:

  Broadcast and cable television

  PPV/VOD

  DVD distribution

  Internet transmission"

It does not specify by country. But I think it's safe to assume that if the film is released on Netflix anywhere else in the world prior to its US theatrical qualifying run, it will be disqualified.

Don't a lot of movies premier at festivals though? I thought that was a theatrical exhibition.

While most film festivals aren't public affairs (TIFF, however is a public festival), I think this rule specifically applies to non-theatrical public exhibitions, meaning television, DVD distribution, streaming, etc. Basically what the rules say. Film festivals are an integral part of building buzz for films that have yet to secure distributors or make their mark on the awards race, so I believe that's why the rules don't specifically state that  a theatrical exhibition at a festival disqualifies a film.

It opens in LA on Friday. LA Times doesn't specify the theater showing though...

"Gaga: Five Foot Two

Documentary portrays eight months in the life of multifaceted performer Lady Gaga. Directed by Chris Moukarbel. (1:40) NR."

And here's an interesting twist - Regal Cinemas, the second-largest theater circuit in the US, has it listed as Coming Soon. So, alongside having a qualifying Oscar's run, they will put it in wide release to make a few bucks as well.

I messaged to Heather Parry, film producer for Live Nation regarding this rule.

She answered "We know. Thanks for the support". So, no worries then.

To be honest, I don't believe it matters much to anyone promoting this film. It's not strong enough to enter the Oscar race. This will do lots to bolster Gaga's positive image in the eyes of the public, and will be a hit for Netflix. I think that's all that matters to them.

It looks like it will also be wide-released. Regal Cinemas has it on the list of Coming Soon, but no dates just yet.

Doesn't TIFF count as a public exhibition though?

I definitely don't think that will happen. That would be unprecedented for a Netflix title. Netflix is trying to shift the theatrical release paradigm with its streaming titles, and only releases select titles in limited release the day they go to streaming to qualify for Oscars. A Netflix original release has never gone wide, and that won't happen with this one.

I don't believe film festivals are counted as public exhibitions under the rules, because many Oscar-bound films premiere at Toronto and other film festivals around the world.
