Zuckerberg being investigated in Germany over hate content

Prosecutors in the Bavarian capital are conducting an investigation into Facebook founder Mark Zuckerberg and other heads of the social media giant over potentially illegal posts on their website, Spiegel reported on Friday.

COO Sheryl Sandberg, European policy director Richard Allan and Eva-Maria Kirschsieper, who heads the company’s Berlin office, are all also under investigation, according to Spiegel.

Prosecutors confirmed the investigation to the Frankfurter Allgemeine Zeitung (FAZ) as well.

Investigators must prove whether there is enough evidence of a criminal offense and whether it would fall under the Munich prosecutors' jurisdiction.

The probe was initiated after a Bavarian lawyer reported the company to police, accusing its management of allowing racism, Holocaust denial and violent threats to remain on the site without consequence.

Facebook is legally bound in Germany to delete all known content which can be considered incitement of hatred.

The criminal complaint lists a series of postings which were reported to the company but were not deleted, with the complainant either being ignored or receiving a standard reply describing the post as “harmless” Spiegel reports.

Facebook has come in for heavy criticism from German politicians for over a year for what they say is its unwillingness to deal with hate speech on its site.

In October Volker Kauder, a key member of Chancellor Angela Merkel's party, said that social media giants like Facebook should face penalties if they fail to tackle hate speech, after a surge in xenophobic comments linked to the migrant influx.

“The time for round-tables is over. I've run out of patience," said Kauder, chairman of the Christian Democratic Union's parliamentary group.

Despite a pledge in December last year by Facebook, Twitter and Google to examine and remove offensive posts in Germany within 24 hours, users have reported that their requests to take down hate speech have often hit a wall.

Kauder said that if the companies fail to remove offensive posts within a week after they have been reported, then they should be penalized, with a suggested fine of €50,000 per post.

"If the companies refuse to meet their responsibility, then there will be consequences," Maas told business daily Handelsblatt."

****ing finally. I'm sick and tired of Neo-Nazi pages popping up like mushrooms and facebook turning its head away. Back when still had facebook I got notified that all my reports were not cleared because they're protected by "freedom of speech" or that "no hate speech was detected" when the page I reported had a display picture that literally read "Kill all jews"

Yes, threats and the like should be deleted, but that's where I draw the line. Facebook and other social media sites should remain impartial and shouldn't be deleting posts that don't align with their political views. Yes, holocaust denial and the such is stupid, but the beautiful thing about Facebook is that you don't follow any racist pages, you won't see any racist posts. As long as people aren't inciting violence through what they post, they should be free to exchange their ideas and engaging in discussion and debate

I kind of disagree with you. Being a Nazi is on the edge of being not allowed in Germany. Racist posts arent 'ugh, that (insert religion) guy was so dumb' it's more hateful. It's about killing those people, killing refuge houses. It's Facebook Groups talking about such things. If they exist on facebook, it'll be harder for the police to investigate in the end if a 'Nazi Attack' is happening. Also it's spreading the word of more hatred.

Holocaust denial is nothing to discuss about  Facebook uses a weird algorithm where they suggested me to like a really anti-jewish site where they made fun and memes of Jews and ovens etc, because I liked a lot of jewish related pages.

If they're posting about killing people, then that's inciting violence and as I said shouldn't be allowed it all, and most likely a Nazi page would have been created with the intention of inciting violence in the long term, and thus shouldn't be allowed. 

I think I probably could have been a bit clearer in my first post, I was more referring to stuff like holocaust deniers, which is quite similar to flat earthers in that they shouldn't ban the discussion of such topics just because they don't agree with them.

It's not similiar. Holocaust deniers denying the death of millions of people. (including my ancestors) and nope I won't just accept their silly mind. Their kind set of mind needs to be banned.

Yes, what they say is disgusting and I don't agree with it in any way, but you can't just prohibit discussion of things you don't agree with. That's a very dangerous slope to be on.

North Korea is a prime example, where all discussion that the state doesn't agree with is strictly prohibited and punished with indefinite incarceration.
