P.S. Y'all keep ignoring Gaga's message for Born This Way with the whole "that's not very Born This Way of you". I think she said a thousand times that it was about reinventing yourself until you are who you want to be.

To date, Swift has been protective of her brand, and has filed for 121 trademarks in total (with 54 currently registered in the US - mostly for her own name (and variations of it) and also for the album title “Speak Now”). So far, so normal - the list below, of trademarks filed by other current pop artists, reveals that Swift is certainly not acting unusually in her brand protection strategy:

Kanye West - 337 trademarks applied for

Taylor Swift - 121

Justin Timberlake - 112

Lady Gaga - 93

Rihanna - 74

Eminem - 49

Beyoncé - 44  

One Direction - 27

Katy Perry - 27

Justin Bieber - 18

However, when the news broke last week that Taylor Swift had filed a number of trademark applications for phrases taken from her latest album 1989 (including song titles and lyrics such as “This Sick Beat”, “Cause We Never Go Out of Style”, “Party Like It’s 1989” and “Could Show You Incredible Things”), the resulting media coverage suggested that Taylor Swift was tearing up the rulebook in terms of IP protection. Many articles included the usual confused mish-mash of IP terms (“Taylor Swift copyrights 'This Sick Beat'”, “Taylor Swift patents lyrics of her songs”, etc) and consistently referencing that Taylor Swift had ‘trademarked’ the terms (suggesting the USPTO has made a decision and approved the marks). Some went further, claiming that the trademarks mean Swift would effectively ‘own’ the words (with one report stating that “Swift is ensuring that no other artists use these lyrics in other songs”).

Mark H Jaffe, a trademark and copyright lawyer at Tor Ekeland PC, voiced his dismay at the media coverage, telling World Trademark Review: “It puts this heavy emphasis on the trademarking of the lyrics. If we can put aside the fact that using ‘trademarking’ as a verb is confusing, it creates this false impression to the public of a monopolisation of the English language. She’s not actually seeking to trademark lyrics, that cannot happen. Taylor Swift is using, or planning to use, phrases in connection with merchandise that she already sells and those phrases happen to be associated with her songs. I’m not sure if the public, who could understand this, would understand that from reading the media reports.”'

 

If gaga can do this:

Surely Taylor can trademark a few lyrics.. Now I am by NO MEANS saying that Taylor invented the phrases, "this sick beat", "party like it's 1989", etc., but as stated in the article (Which you can find here btw: http://www.worldtrademarkreview.com/Blog/detail.aspx?g=61ccf10f-885e-4aa6-9d04-3421f8c7e3b4 ) "Taylor Swift is using, or planning to use, phrases in connection with merchandise that she already sells and those phrases happen to be associated with her songs"

Another thing to note, Taylor has made 121 trademarks in the almost 10 years she's been a big star, while Gaga has made 93 in about 7 years, it's a similar amount of trademarks in respect to the amount of years they've been full blown artists.
