Columbia University student Paul Nungesser is suing the university because he says it allegedly let him be harassed by “Mattress Girl” Emma Sulkowicz, who accused him of raping her.

The news broke on Thursday evening, and the text of the lawsuit has been published online, and its contents are astonishing.

While Sulkowicz has become a national hero in the campaign against campus s-xual assault, the lawsuit uses Facebook messages and other evidence to paint a picture of Sulkowicz as a jilted love interest whose deep obsession with Nungesser transformed into a savage hatred. The complaint extensively draws from Facebook conversations between the two, quoting Sulkowicz as regaling Nungesser with tales of her past and present s-xual experiences. At one point, she expresses fears for her reputation after contracting an STD following drunken s-x at a party.

“i’ve officially had s-x with all of John Doe’ best friends,” she said in the exchange, according to the complaint. “did lotsa d--gs – jk just got very drunk – well anyways – now i have an std i actually hate John Doe like if a girl is about to puke – don’t put your unprotected dick into her. . . I realy don’t want to be known as the girl who contracted an std because she was drunk you know? it is more his fault for ****ing me unconscious – i mean i was conscious but clearly not in my right mind. . . i was literally blackout. . . like i puked all over the place.”

The complaint also argues that Sulkowicz showed an intense romantic interest in Nungesser during the summer of 2012, which Nungesser spent in Germany. She sent him more than a dozen messages along the lines of “PAUL I MISS YOU PAUL I MISS YOU PAUL I MISS YOU PAULLL” and “I would LOVE to have you here – omg – we could snuggle.”

The lawsuit even argues it was Sulkowicz herself who first broached the possibility of a--l s-x with Nungesser, even though claims of forced a--l s-x are central to her claim of rape.

“**** me in the butt,” she said bluntly during one Facebook exchange.

The lawsuit also accuses Sulkowicz of persistently dishonest behavior after she began accusing Nungesser of s-xual assault. For example, the lawsuit says that local police decided not to charge Nungesser due to a lack of evidence, but that Sulkowicz claimed she had simply decided not to pursue charges:

Three weeks after Paul’s criminal attorney was informed that rape charges would not be brought against him, Emma falsely announced that she personally decided not to pursue criminal charges against Paul:

“I decided I didn’t want to pursue it any further because they told it me it would take nine months to a year to actually go to court, which would be after I graduated and probably wanting to erase all of my memories of Columbia from my brain anyway, so I decided not to pursue it.”

Emma conveniently omitted the fact that the Sex Crimes Unit refused to bring any charges against Paul following its investigation, due to a lack of any reasonable suspicion.

Of course, Nungesser’s lawsuit isn’t even against Sulkowicz, but rather Columbia University, and the complaint also makes several severe allegations against the university to justify Nungesser’s claims of harassment. The complaint notes Columbia’s own s-xual assault policy requires participants to respect the privacy of everybody involved, and promises punishment to those who engage in “retaliation” against the accuser, accused, or any witnesses in a s-xual assault case.

Rather than punishing Sulkowicz for publicly vilifying Nungesser, however, the university instead provided indirect funding for the effort. For example, last December, an event hosted by the Columbia groups No Red Tape and Carry That Weight publicly read a letter outside President Lee Bollinger’s office repeating the claim that Nungesser was a “serial rapist.” Columbia, the lawsuit says, essentially sponsored this event by failing to charge the groups for the full cost of clean-up after their event.

“President Bollinger thus displayed a contemptible moral cowardice in bowing down to the witch hunt against an innocent student instead of standing up for the truth and taking appropriate steps to protect Paul from gender based harassment,” the brief says.

^^I really encourage you all to read some of it. It shows just how twisted Emma really is. 

Basically she and Paul become friends and develop some sort of platonic relationship and eventually become 'friends with benefits.' She develops affections for him over the summer, and her affections go unreciprocated. She gets mad at this and vows to get her revenge on the guy and files a complaint with the University alleging she was raped- which she loses. Then she gets two of her friends to file complaints against Paul- which they lose too. Emma claims that she was brutally attacked and raped by Paul, but Columbia find no bruises; there is no medical report; her friends and family could not confirm the alleged injuries- etc. nothing. Eventually she starts taking her mattress to school as some form of 'art project' and gets National attention, the attention of a Senator, and gets to attend the State of the Union Address. An innocent man's life is ruined, while she gets to become some sort of 'hero.' Disgusting.

As is evident from Emma’s Facebook messages to Paul during the summer priorto their sophomore year, Emma’s yearning for Paul had become very intense. Emma repeatedly messaged Paul throughout that summer that she loved and missed him. She was quick to inquirewhether he was in love with the woman he was seeing abroad.

Thereafter, she continued pursuing him, reiterating that she loved him. However,when Paul did not reciprocate these intense feelings, and instead showed interest in dating other women, Emma became viciously angry.

More than seven months after the Sophomore Sexual Encounter with Paul, Emma filed a gender-based misconduct incident report (the ’Report ) at Columbia’s Office of Gender Based Misconduct. Shockingly, she alleged that during the Sophomore Sexual Encounter with Paul,"he began to choke her, slapped her face, pinned her arms ad-penetrated her a--lly. 

She said she had screamed for him to stop, but that he would not.
She also stated that It could take two minutes for it to stop, or he could have strangled me to death.

Columbia proceeded with an investigation (the Emma investigation ) that spanned seven months and culminated with a two-hour hearing (the Hearing ), which took place on October 29, 2013, at which Emma and Paul both testified. At the conclusion of the Hearing, Columbia discredited Emma’s entire story, finding Paul not responsible for the alleged non-consensual s-xual intercourse.

Paul readily prevailed against Emma’s false allegations in spite of his being precluded from presenting Emma’s Facebook messages either during the Emma Investigation or at the Hearing itself. Nonetheless, Paul was vindicated despite the fact that Emma’s burden of proof was only a preponderance of the evidence standard (i.e. more likely than not).

In an effort to bolster her ease, and driven by her feelings of rejection and interest in making a public impact and statement, Emma approached several women with whom she was friendly, encouraging them to each report Paul to the University for s-xual misconduct. Two women acquiesced.39.
The first, Jane Doe #1, who was also a member of ADP, filed her complaint against Paul at the end of April or early May 2013, shortly before her graduation. Jane Doe #1 erroneously and wrongfully alleged that a full year prior to her filing (i.e. during the end of her junior year, which was the end of Paul’s freshman year), Paul had grabbed her at a party and
tried to kiss her. This allegation was sheer fabrication. Columbia agreed with Paul, ultimately finding him not responsible for the alleged non-consensual s-xual contact
. ’40.

Jane Doe #2, who had been Paul’s girlfriend for several months while they were
both freshman (prior to Paul’s s-xual intercourse with Emma), was also enticed to file a false
report against Paul, alleging s-xual misconduct. Jane Doe #2 reported that she had the
impression while Paul was her boyfriend, that she could only see him if she had s-x with him,and thus she felt obligated to have s-x with him. She never alleged physical coercion, violence,
or rape. She filed her complaint at the same time as Jane Doe #1. Columbia found a lack of sufficient information to indicate that reasonable suspicion exists of any alleged intimate
partner violence and thus terminated Jane Doe # 2’s investigation without any need for a hearing.

I'd like to hear her side before I pass any judgment :laughga: I have trouble believing that she would go through soo much trouble with the mattress to bring attention to campus rape if it didn't happen, especially since there was no guarantee she would have any impact or receive any coverage for it :shrug: Like, its entirely possible she did like him, AND he raped her;  she could have changed her mind during, etc.

Rather sounds like a guy who is upset that he couldn't get away with rape. All of the claims are pretty generic and feel like they have been brought up to court in a thousand different rape cases where the rapist faced public repercussions.

​Well, first the cops refused to bring charges, then a Campus Tribunal found him not guilty, but the girl refused to accept the verdict and tried to vilify him with her Mattress stunt, which created a hostile environment for him. For a long time ONLY her side was reported and the media largely "listened and believed" (because it fit the campus "rape culture" moral panic narrative).

But if you read the transcripts you can see how manipulative she is. She even got two of her fiends to falsely accuse the guy of s-xual misconduct -only to be dismissed. Once all three of her schemes fell apart, she then starts this mattress-carrying 'performance' in the hopes that she'll get some attention- which she did. I agree with your second sentence on that "there was no guarantee that she would have any impact," but honestly with how prominent social media is these days sooner or later someone is gonna take notice, post it on social media and viola now you have a story.

I don't honestly. With how prominent social media is these days, we have seen countless of stories of people victimizing themselves in the hopes of creating sensationalist headlines and what not. Once I read through the transcripts it all started to make sense, and I got to see how twisted she is. 

It's disgusting how the MSM has focused so much on these two sensationalist  'rape' cases (this one and RollingStone's 'Rape on Campus' story)- only for them to fall apart in the end. These two stories were the work of propaganda designed by agenda- pushing nutjobs who focused on pushing their agendas rather than doing some fact checking and investigation FIRST.

And stories like these two end up hurting real victims of rape by lending more credibility to the "they're making it up" shtick that is often associated with victims of s-xual assault. Deplorable.

​Yea that's true too. But in this case it's different because the girl got national attention + was invited to the State of the Union address as a guest of honor. Ridic.

That's the problem with "Obsessed" people.   They are blind to any reasonable behavior.  Its the same with stalkers, they don't think that they are doing anything that would freak out the victim, they just want to get what they're after.  With this case , it may be that her ego couldn't take rejection and felt compelled to make him look like the bad guy.
