Colorado legalized Same-Sex marriage again; more states to follow.

Colorado officially authorized same-s-x marriages on Tuesday, joining the wave of states reacting to the U.S. Supreme Court’s decision not to hear any pending appeals on gay marriage. The court's action effectively made gay marriage legal in states where about two-thirds of the nation’s people live. Eleven more states were working on the technicalities of allowing same-s-x marriage after the ruling.

 

On Tuesday, the Colorado Supreme Court lifted injunctions against three county clerks, allowing them to begin issuing marriage licenses to same-s-x couples. Less than an hour after the injunctions were lifted, Colorado Atty. Gen. John Suthers gave all 64 county clerks the order to begin issuing marriage licenses.

 

“There are no remaining legal requirements that prevent same-s-x couples from legally marrying in Colorado,†Suthers said in a statement posted on his website. “Beginning today, Colorado’s 64 county clerks are legally required to issue licenses to same-s-x couples who request them. In addition, the Colorado Department of Public Health and Environment is required to register such marriages in the records of the State of Colorado.â€

“This is a wonderful day for Colorado and especially for couples and their families who have been denied this fundamental right for far too long,†Boulder County Clerk and Recorder Hillary Hall said in a statement.

 

Colorado holds a special place in the annals of the fight over same-s-x marriage. Almost from the day the federal appeals court in June legalized gay marriage, county clerks fought with the attorney general’s office over the issue.

 

Earlier, Douglas County began issuing marriage licenses to same-s-x couples on Tuesday, following similar action in Pueblo and Larimer counties, which began issuing licenses on Monday. Stacey Nowlin and Leona Rogers were apparently the first same-s-x couple to receive a license in Colorado and were married at the Pueblo office around noon.

That ceremony was among those that followed the U.S. Supreme Court’s decision to decline to hear any pending appeals on whether state prohibitions on same-s-x marriage violate constitutionally protected individual rights.

 

The Supreme Court action let stand appellate court rulings overturning state bans in five states and made it easy for activists in six other states to move quickly to get gay marriage approved.

At the start of Monday, 19 states and the District of Columbia had legalized gay marriage.

After the Supreme Court decided not to act on suits from three appellate circuits, gay marriage became legal immediately in five more states -- Indiana, Oklahoma, Utah, Virginia and Wisconsin.

Same-s-x marriage will also be permitted in six other states covered by those circuits: Colorado, Wyoming, Kansas, West Virginia, North Carolina and South Carolina.

States in other circuits, especially the South, will have to see what their court systems do. In the 5th Circuit, both sides are watching to see what will happen when a Texas case works its way through the courts.

 

In the five added states, county clerks opened their offices and began issuing licenses almost immediately. Typical was the scene in Oklahoma, where Mary Bishop and Sharon Baldwin, plaintiffs in that state’s federal suit, were among the couples who were issued marriage licenses.

The Tulsa County court clerk's office issued the couple a license Monday afternoon.

Gay couples in Utah exchanged kisses and cried at news conferences as they applied for marriage licenses.

 

A handful of same-s-x weddings took place in Salt Lake County. A federal court in Utah was the first to back gay marriage and that case became the test case in the circuit which includes Colorado.
