I don’t think someone who designed a logo, and then years later sees an A list celebrity is using a similar logo with the same text, is greedy.  They’re just trying to protect their own intellectual property and they have enemy right to do that.

I doubt the person who designed the logo is involved. They likely outsourced logo design to a marketing or design firm. But regardless, it’s typical for the losing party of a lawsuit to foot the legal bill.

Why are we having so much discourse over what was a blatant stunt lawsuit gone wrong? 

Sifters try hundreds of these cases because more often than not the bigger brand just offers them a cheque to make it go away quickly and hassle free. 

Its blatant scam lawyer bs just like all those ambulance chaser personal injury lawyers. They looked for a quick buck and flopped.

Just to be clear, the trademarked design of the logo is just the word “mayhem” in regular font, so they have no legal rights for the official design and Matt Biolos designed it in the 80s for his high school punk band.

There’s just no case here and 0 similarities but the name, it’s not an opinion, it’s a simple fact 🤷‍♂️

If you can prove there is a similarity, then go ahead, I’m waiting

But Gaga isn’t suing them, she’s COUNTER suing them for expenses that she did not need to pull out in the first place. Taylor Swift has sued people (including her fans) first for using her image. 

Their claim was that it infringed their copyright, which means people would buy Gaga’s merch assuming it was theirs. Which would require a low IQ to do so.

if I was the creator of the original surf mayhem logo and then I saw Gaga’s mayhem logo, I’d certainly want them to change it, as it is very similar- again, even if it’s unintentional.

 

imo Gaga’s team should just settled it out of court with the surf company.  I feel bad for them. They did nothing wrong .  Gaga did nothing wrong either! Of course - but now it sucks for this company to first deal with an unintentional copied logo, and now have to pay for Gaga’s legal bills… it just seems unnecessary imo

I’m sorry but they DID do something wrong, or at the very least, stupid. Anyone with an ounce of knowledge in trademark knows this was a dead case on arrival and they still went with it. Even if they looked similar, trademark rights don’t protect appearance of a logo in all cases. They have even said they’ve been through this process before in the past so it’s not like they were ignorant of the law. They took a stupid risk and now they have to pay the stupidity of their actions

Well I imagine it’s also a business tactic to deter any other type of lawsuits in the future from other opportunists 

though I do think on principle it’s gauche to do for the reason you stated
