Lost v. Gaga lawsuit leak over Mayhem logo, delaying tour threat

I know someone with a sub so I saw it myself, and it’s essentially more about his precious brand image getting hurt rather than money. (Personally I think it’s about ego and money once you look into the owner of Lost, Matt Biolos, lol) Saying that Lost’s reputation will be “destroyed”, and the brand and identity will be “consumed by Lady Gaga’s fame” and “dominant influence”. They want her to remove Mayhem branded tour merch from her store with the logo, and they alluded to delaying the tour:

“If Lady Gaga removes the Mark from her merchandise, Lady Gaga may commence her concert tour without a delay and continue the sale of clothing. There is sufficient time for Lady Gaga to remove the infringing mark from her tour merchandise for sale at her concerts.” 
 

Likely why the new merch has a new logo. 

They argue customers have been confusing Gaga’s Mayhem with the brand when entering stores, or under social media comments, but I’m just wondering…how many people really? How many surfers and skaters even know Abracadabra exists? It’s not even a competing market?  

The court hearing was delayed due to the LA ICE protests, but should be starting soon….

I believe the suit is about her using the Mayhem logo on merchandise, because their Mayhem trademark is for clothing and merchandise. If you look at the registered trademark document/patent itself, it only lists “For: beanies, caps, jackets, pants, sandals, shorts, t shirts, tank tops”. And “the mark consists of standard characters without claim to any particular font, style, size, or color”…still weird to me that they can trademark a word’s usage specifically on merch

Ngl I absolutely see the similarity and had heard of the brand before, but the concept of the font is so generic that I don’t see how they could possibly claim that it’s a unique trademark.

So this explains why the old logo is just completely removed and we have a new logo. Sad bc the old logo is so iconic

what i dont understand…is if the trademark doesnt claim a particular font, and it’s just simply the word being used on merch, why is her new merch all of a sudden okay for them? I’m assuming because it is less “confusing” for their customers. They specifically say the logo is “shockingly similar” and “misappropriated” the “Stylized mark”; but the trademark doesnt claim a font or style? Maybe they mean that they can just sue any use of the word no matter what the style is?

If it's the word, they are even more delulu because that means that no one can use the word on clothing or merch, not even the band that literally is called Mayhem. Even if it's not the word but the 'similar' logo, there are very similar fonts that you can use for free. The style is pretty generic, if I remember correctly even the font is called Mayhem

I don't know how they could trademark a logo with a font that has very similar variants and can be used for free +  the brand having a pretty common name 

I think this will not affect Gaga in any way. I think it will be dismissed, of course there are similarities but that's because the whole concept regarding font and style is very generic for both cases

The brand owner is kind of infamous in the surf community I think, lots of people wont even buy Lost boards because of their distaste towards him. Like I saw someone calling him a right wing nut job…list goes on…When this first came up, the Surfing subreddit was mostly dunking on him and not taking it seriously. I got the impression he’s just taking advantage of his trademark and trying to get money out of this, under the guise of it hurting his brand image, just based on how people talk so negatively about him
