Ngl the legal basis of Newsom’s appeal wasn’t that strong. He made an appeal to the escalatory intent of the deployment (which is obviously true, but that doesn’t necessarily make it unlawful) and also claimed that the deployment was outside of the scope of Posse Comatitus (not true because the Marines can technically legally be deployed anywhere at any time to protect federal property).
