The first thing I thought when I heard Gaga's new album was gonna be called Mayhem is that she must be inspired by the old 80s black metal band, Mayhem. The surf brand almost certainly copied their idea from the metal band, and then perhaps Gaga or her graphic designer were subsequently inspired by the surf brand. So the surf brand couldn't copyright the ideas because they (very easily demonstrably I might add) aren't original themselves. "There are only 12 notes between any octave, and then the octave repeats. All any artist can offer this world is how they see those 12 notes. That's it." Case closed, legal sistren. There are MANY people who have trademarked Mayhem for different purposes. When you file a trademark, you file it in different categories and say what you are selling. This surfboard company lists "surfboards" as their product. Therefore, people using Mayhem to sell OTHER types of goods and services are not bound by their trademark in the first place. 2) There are 2 ways to trademark in this case. You can trademark just the text, or you can trademark the graphic alongside the text. As you can see in my link, this company DID NOT EVEN include the design in their trademark, it's a text-only trademark. 3) Even IF we are comparing the graphics, the fonts are not similar and though there are some similarities, the surfboard company's logo is NOT unique either, as other logos have looked like that before them.
