Rocky has hired attorney who represented Donald Trump in the past. his defense is that he carried a prop gun from the set of a music video he filmed with Rihanna and fired twice with this fake gun. 
He said that the gun no longer exists. also no gun was found by police but they found a half-empty magazine for a Glock 43 in his closet.
there is a witness who called 911, she said she heard shots and saw flashes which supposedly proves that it was a real gun....

Surely there must be more conclusive evidence for them to take it to trial and push for such a sentence?

they got video of him holding a gun and fighting with the alleged victim just before the shooting.
there is also another video on which shots can be heard. this video is black and white and not clear enough to see who shot, but the 911 caller identified Rocky as the shooter, "guy in the black sweatshirt" and  the victim "guy in blue".
