There's no way they don't win. Pal world's whole gimmick is ripping off Pokemon as much as they can, I don't get how the developers thought they could get away with it.

You can collect evidence for months before a lawsuit ever goes to trial. I want to bet Nintendo had their fingers on Palworld's pulse (their player count) and waited until they thought nobody would care if they sued. Sad practice by Nintendo honestly. Keeping animals in portable containers shouldn't be copyright, trademarked, or patented. And it's gonna be another display of a conglomerate bleeding a smaller company out of money through legal fees.

I was mostly being sarcastic lol, I work adjacently with legal (albeit a completely different industry). 

I think the fact that Nintendo is choosing to explore patent infringement as opposed to a copyright lawsuit is very telling; they either feel they have enough evidence of, or believe they can prove, that the Palworld developers infringed on use of their IP technology as opposed to just character designs (which seems to be what a lot of Pokemon fans and Palworld fans are hung up on). I really do wonder how this will play out in courts too as Japanese legal systems are not the easiest to navigate.

Im all for small, indie game dev to thrive but in this case im on nintendo side since it involve AI, stolen asset & design
