I'm so sick and tired of the most evil, corrupt, disgusting companies and (heads of said companies) becoming extremely successful to the point we have to use their services day-to-day. I want to support good people. But good people don't own 90% of film and TV and hold it behind a paywall. Good people don't own the warehouses and websites that sell us affordable goods. Good people don't provide the services we rely on every day. Good people don't have the ability to employ thousands of people and get to pay them liveable wages and provide good working conditions. they know they wont win with that argument but theyre gonna throw whatever they can at this to try to drag this out as long as possible and drain the plaintiff of their resources

Disney + has nothing to do with a restaurant in Disneyworld & the expectations that come with health and safety regulations. Restaurants will always have to be held to standards, and a Disney + subscription doesn’t give them free rein to not have their restaurants held to food and safety regulations and standards.

The death is so sad omg. Just horrible.

Part of me does think that if you are that deathly allergic to both dairy and nuts, you should simply never eat at restaurants that turn so many tables. Disney does have an excellent reputation as allergy aware company in their theme parks, but this is an extremely popular third party restaurant that does not have an extensive allergy menu like Disney owned restaurants. Things can much more easily go wrong, especially if you order food that comes out of a shared fryer... (I eat vegan and love Disney World so I'm aware of the hassle of getting lactose free/allergy options). It sucks that you have to do all of this research before eating somewhere, but I hope this case reaffirms the importance of it anyway.

Even if a product does not "contain" dairy and nuts, cross contamination is very easy when you order fried food (and they did, twice). I know this place has a dedicated gluten free fryer but I doubt they have a dedicated "allergy fryer" for nut allergies. This is why all the menus shown at Disney note that they cannot guarantee that items are completely allergy free, even if they will prepare it "allergy friendly". I understand that a waiter does not know the intricacies of the danger of that when they think the customer is simply asking if there are nuts and dairy in their option. I hope this case results in some kind of added policy where waiters ask customers exactly how allergic they are.

Anyway, no surprise that Disney hoped to get out of this. And legally speaking, they are right: you do explicitly agree you arbitrate all future disputes with the company. Sucks but hey. They can still sue the restaurant company, which is best anyway.
