Singing over the top of a backing track during the chorus =/= lip-syncing.

She did it during the Monster Ball too and a lot of other artists do it. It wouldn't sound as good without it. While she's dancing and out of breath it helps fill the sound and make it sound more like the track.

You're right. The thing about the Monster Ball that let her "get away" with it, was that they were back up singers. The fact that it's her own backing vocals playing seems to make everyone feel weird about it.
